Competition Terms and Conditions
- Information on how to enter and prizes forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- Entry is limited to Australian residents aged 18 years or over ("Entrants"). Employees (and their immediate families) of the Promoter and its agencies associated with this promotion are ineligible to enter.
- The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- To enter the promotion, Entrants must, during the promotional period, visit the website www.optus.com.au/wildlife, play "Save Them for a Song" to compose a short song and complete the entry form to submit their song for entry. Entrants must complete the entry form, including their full name, address, telephone contact and email address details, and submit the completed form during the promotional period.
- 5. Promotion commences 9:00am AEDST on 2/04/08. Final entries close at 11:59pm AEST on 6/06/08. Entries not received by that date or not completed in accordance with these Terms and Conditions will not be eligible to win.
- 6. Multiple entries permitted however each entry must be submitted separately and in accordance with entry requirements. While multiple entries are permitted, there is only one prize permitted per Entrant (excluding SA and ACT residents.) All entries are deemed to be received at the time of receipt by the Promoter NOT at the time of transmission.
- Incomplete, indecipherable, inaudible or illegible entries will be deemed invalid.
Major Prize
- Judging for the major prize will take place at Optus, 1 Lyonpark Rd, Macquarie Park NSW 2113 at 11:00am on 10/06/08 (AEST).
- The two entries judged to be the most creative will each win a trip for two to Australian Wildlife Conservancy’s Mornington Sanctuary in Western Australia valued at up to $7765 depending on point of departure. Prize includes return economy airfares from winner's nearest capital city (if necessary) and one night’s accommodation (twin share) in Broome on 28th August 2008, transfers from Broome to Mornington Sanctuary and three nights’ accommodation (twin share) at Mornington Sanctuary from August 29th to September 1st 2008.
- Major prize winners will be announced on www.optus.com.au/wildlife on 13/06/08. Judges’ decision is final and no correspondence will be entered into.
- Spending money, meals, taxes, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken on the dates specified above to coincide with the bookings secured with Mornington Sanctuary.
- Frequent flyer points will not form any part of the prize. Prize is subject to the standard terms and conditions of individual service providers. Winner may be required to present credit card at time of accommodation check-in.
Instant Win Component
- All Entrants are also eligible to be in the Instant Win prize draw. Entrants who submitted a completed entry form (details on how to enter as per term 4) will go into a random draw and notified immediately if they have won an instant win prize and the details of the prize that they have won.
- The Instant Win prize draw includes ten Motorola W375 Mobile phones valued at $99 each, 50 Australian Wildlife Conservancy Wildlife packs including a year’s subscription to "Wildlife Matters" valued at $25 each, 100 6-month subscriptions to DMAG Magazine valued at $28 each, and 1,000 free PC wallpaper downloads.
- Motorola W375 mobile handsets supplied are locked to the Optus network. An $80 fee applies if network locking is removed within 6 months of your activation date. If you have recharged to the value of $80 no fee applies
General
- If for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be transferable or redeemable for cash and the winner will forfeit the prize
- If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
- Total prize pool value is $20,570. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
- A draw for any unclaimed prizes will take place at 15:00 (AEST) on 10/09/08 at the same address as the original draw, subject to any directions from a regulatory authority. Winners’ names will be published on www.optus.com.au/wildlife
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
- Entrants consent to the Promoter using the Entrant's name, likeness, image and/or voice in the event they are a winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize
- All entries become the property of the Promoter. The Promoter collects Entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the Entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each Entrant also agrees that the Promoter and its related bodies corporate may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Entrant, including sending the Entrant electronic messages. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation.
